Personal Training Purchase Agreement for In-Person Training


Welcome to Body By Ruthie Personal Training and congratulations on beginning your personal training program! I am delighted you chose me as a part of your commitment to health and fitness. With my help, you will improve your ability to accomplish your training goals faster, safer, and with maximum benefits. The details of these training sessions can be used for a lifetime. In order to maximize progress, it is important to follow program guidelines during your training days. Remember, exercise and healthy eating are EQUALLY important!  The following information will provide you with important program policies. Before getting started, please read and sign this form to acknowledge that you have read and understand the following information.


Information and Policies


This Agreement is made and entered into on the ______ of ______________________, 20___, by and between ________________________ (“Client”) and Trainer.  In consideration of the mutual promises exchanged herein and other good and valuable consideration, the parties agree as follows:


1. Commitment: By purchasing Sessions, Client is making a commitment to his/her health. Clients should follow the program and instructions of Trainer to the best of their ability to maximize their results and better achieve their goals.  Remember, the ultimate results are up to the Client. Trainer will show Client how to work his/her muscles correctly and encourage him/her to go to his/her safe limit, but Client is the only one who can make sure he/she works out consistently, eats properly, gets plenty of sleep, and lives a healthy lifestyle.


2. Specifics: Trainer and Client shall agree upon the time, program type, content, and location of personal training sessions (“Sessions”) at the rate set forth on the attached rate sheet and detailed below.

3. Length of Sessions: Sessions will last approximately sixty (60) minutes, including warm up and cool down time. Trainer may opt to vary the length of sessions at trainer’s discretion.


4. Punctuality: Client shall be attired as discussed below and ready to train at the time arranged by the parties. Failure to be prepared to train may result in a shortened workout or possible cancellation of the Session under paragraph eight (8) below if Client is more than fifteen (25) minutes late. If Client anticipates running late, he/she should contact Trainer as soon as possible by phone at (410) 491-5543 .


5. Attire: For in person session client must wear comfortable workout attire, including, but not limited to, clean t-shirts, shorts, tights, sweats, and/or tracksuits. Athletic shoes must be supportive and functional. Please do not hesitate to ask Trainer for advice on what type of clothing and shoes is appropriate. 


6. Stopping Exercises: Client may refuse or stop any exercise for any reason. It is Client’s responsibility to notify Trainer of any discomfort or pain arising from or during exercise, as well as, any and all other known limitations Client has or experiences so that Trainer may accommodate Client and substitute another exercise to work that particular muscle group.


7. Payment: Payment must be made in advance of Sessions in one lump sum unless other payment arrangements are made.  PACKAGES ARE NON-REFUNDABLE.  Payment must be completed for all Sessions before any new or renewal contract may be signed. Trainer accepts cash, check or credit card through the Paypal™ system. It is Client’s responsibility to pay his/her bill, even in the event he/she does not receive an invoice. If Client’s payment is more than two weeks overdue, Trainer may suspend Sessions until Client’s outstanding invoice is current.


Client acknowledges and agree that this Personal Training Contract is not transferable or assignable and acknowledges that payment is required for blocks of sessions in advance of actual training sessions. Client understands that all monies paid pursuant to this Contract are non-refundable. Client understands that this contract and the terms it presents is for the purchase of sessions and any other purchase of services in the future. Client acknowledges that this specific contract, release of liability, consent, and agreement is continuously valid indefinitely. Client understands that a minimum requirement of one session per week must be completed or Client will be charged for the session(s) missed.  No refund will be granted for sessions that have not been completed within sixty (60) days of the expiration of the training sessions. Client understands that Trainer has the right and the authority to terminate the program at any time, with no refund, if Client does not follow the program or fails to conduct herself/himself in an appropriate manner.


8. Cancellation of Individual Sessions: Twenty-four (24) hour cancellation notice, by phone (410) 491-5543 or email (, is required for rescheduling or cancelling any and all individual Sessions. Any and all cancellations with less than twenty-four (24) hours notice will result in forfeiture of the Session without refund. Client understands that appointments will begin and end promptly as scheduled. Client acknowledges that any delays to the start of a scheduled appointment will not be a cause to extend provided services beyond the remainder of the scheduled time. Client will not expect or ask trainer to run overtime. Client understands that if she/he is late, his/her sessions will be canceled and Client will be charged for that session. Client acknowledges that a delay to a scheduled session cannot change the session status to anything else except a whole session and Client understands that there are no half sessions because of any delay.  


If Trainer must cancel a Session, she will do so, by phone and/or email, with at least twenty-four (24) hours notice or Client will receive a complimentary Session for his/her inconvenience. This complimentary Session must be used within sixty (60) days of the date of the cancelled Session. After sixty (60) days, the offer of a complimentary Session will expire.


9. Cancellation and Refund of All Sessions: Client may cancel this contract within seven (7) business days after the day this contract was signed for a full refund of any and all monies paid under this contract. However, Client will be responsible for payment of any and all training sessions received during that time at a rate of the hourly session price for the package purchased. All used sessions will be deducted from refunds pursuant to this section.


10. Option to Renew: Client shall have the option to renew this contract under the same terms and conditions contained herein without the need to execute a new contract. The contract will be extended according to the package purchased. Client agrees to uphold all of the terms contained herein throughout the entire training relationship regardless of whether a new contract is filled out. 



11.  Medical Disclaimer. The information provided by Body By Ruthie online personal training, website and by Trainer is for educational and informational purposes only. It is not intended as medical advice. The information provided by Body By Ruthie website and Trainer should not be used to diagnose or treat any illness, disease, health problem, or metabolic disorder. Always consult your physician or health care provider before beginning any nutrition and/or exercise program. Use of the information, advice, and programs provided by Body By Ruthie is at the sole choice and risk of the reader.

12.  Release, Covenant Not to Sue, and Waiver. Body By Ruthie or any of it's affiliates or other representatives will not be liable for damages arising out of or in connection with the use of any information contained in the website, online personal training or In-Person training. This is a comprehensive limitation of liability that applies to all damages of any kind including (without limitation) compensatory, direct, indirect, or consequential damage, income or profit, loss of of damage and claims of third parties. Personal Training involves an inherent risk of physical injury and the undersigned assumes all such risks. The undersigned hereby agrees that for the sole consideration of Body By Ruthie Personal Training, and Ruthie Lucchesi (Released Parties) allowing the undersigned to participate in the Personal Training Program for which or in connection with which the Released Parties have made available any equipment and facilities for such training, the undersigned does hereby release, covenant not to sue, and forever discharge the Released Parties and employees of any and for all claims, demands, rights, and causes of action of whatever kind or nature including but not limited to negligence, unforeseen bodily and personal injuries, damage to property, and the consequences thereof resulting from participation in any way connected with such recreational programs and activities.  The undersigned understands that this Release, Covenant Not to Sue, Waiver, and Assumption of Risk shall be effective in perpetuity. By signing this document, the undersigned hereby acknowledges that he/she has read the above carefully before signing, and agrees to comply with all the above.
